2. Description of Service
FirstLook is a hiring platform that helps employers identify authentic, high-quality candidates by evaluating their work before seeing their CV. The Service includes:
- Creation and management of job roles with skill assessments
- Candidate application and assessment completion
- Authenticity scoring based on behavioural signals
- Candidate review and CV reveal functionality
- Team collaboration features
3. Account Registration
Employers
To use the Service as an employer, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Candidates
Candidates do not need to create an account. By submitting an application through the Service, you agree to these Terms and our Privacy Policy.
4. User Responsibilities
Employers
As an employer, you agree to:
- Use the Service only for legitimate hiring purposes
- Create assessment questions that are relevant and non-discriminatory
- Handle candidate data in accordance with applicable data protection laws
- Not use the Service to collect data for purposes other than hiring
- Respond to candidates in a timely and professional manner
Candidates
As a candidate, you agree to:
- Provide accurate information in your applications
- Complete assessments honestly and without external assistance (unless permitted)
- Not attempt to manipulate or circumvent authenticity detection
- Not submit multiple applications to the same role
5. Authenticity Scoring
The Service includes authenticity scoring features that analyse behavioural signals during assessments. By using the Service:
- Employers understand that authenticity scores are indicative, not definitive
- Candidates understand that their behaviour during assessments is monitored
- Candidates acknowledge that authenticity scores are not disclosed to them
Authenticity scores should be used as one factor among many in hiring decisions, not as the sole determinant.
6. Subscriptions and Payment
The Service offers various subscription tiers. By subscribing, you agree to:
- Pay all fees associated with your chosen plan
- Provide accurate billing information
- Authorise recurring charges for subscription renewals
Subscription fees are billed in advance on a monthly or annual basis. Refunds are not provided for partial billing periods.
7. Intellectual Property
The Service, including its design, features, and content, is owned by Xander Marketing Limited and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
Employers retain ownership of their assessment questions and content. Candidates retain ownership of their assessment responses, but grant employers a licence to review and use responses for hiring purposes.
8. Privacy and Data Protection
Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you agree to our data practices as described in that policy.
Employers are responsible for their own compliance with data protection laws when using candidate data obtained through the Service.
9. Prohibited Uses
You may not use the Service to:
- Violate any applicable laws or regulations
- Discriminate against candidates based on protected characteristics
- Collect data for purposes unrelated to hiring
- Attempt to access other users' accounts or data
- Interfere with the operation of the Service
- Use automated systems to access the Service without permission
10. Limitation of Liability
To the maximum extent permitted by law, Xander Marketing Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
Authenticity scores and other assessments are provided as tools to assist hiring decisions but are not guaranteed to be accurate or comprehensive.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion.
You may cancel your account at any time. Upon cancellation, your data will be handled in accordance with our Privacy Policy and data retention practices.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our website or sending you an email. Continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
